Protection Mandate or Mandate in Case of Disability

The protection mandate also allows you to clearly state in writing your instructions to your proxy for the management of your property and your own protection.

The notarial protection mandate can only be drawn up when you have legal capacity, i.e. when you are lucid and in possession of all your faculties. Although the protection mandate is drawn up when you are fully capable, its execution is conditional on your incapacity. In other words, the protection mandate will only be applicable when you are incapacitated or disabled.

Specific Power of Attorney

The specific power of attorney allows you to designate a person (proxy) who will have the capacity to represent you for the performance of a specific act. In this case, a specific delegation is given to the proxy for the performance of specific tasks related to a particular act. For example, you give a specific power of attorney to your relative to represent you in the sale of your house. Your loved one, appointed as a proxy, will only be able to represent you in the sale of the house, and will have no other powers of administration over your other property.
